Chapter 134: Ordinance Regulating the Consumption of Alcohol or Possessing Alcohol on the Public Streets and Sidewalks in the Town of Waynesville

Section 134.01. It shall be unlawful for a person to consume a malt beverage or unfortified wine on the public streets of sidewalks owned, occupied or controlled by the Town of Waynesville

Section 134.02. It shall be unlawful for a person to possess an open container of malt beverage or unfortified wine on the public streets or sidewalks owned, occupied or controlled by the Town of Waynesville.

Section 134.03. It shall be unlawful for any person to possess or consume malt beverages or unfortified wine on public streets, sidewalks, alleys or parking lots which are closed to regular traffic for special events.

Section 134.04. For the purpose of this chapter and subsections, an open container means a container with a seal that has been broken or a container other than the manufacturer’s unopened original container. Malt beverages and unfortified wine are defined in North Carolina General Statutes Chapter 18B-101.

Section 134.05. The Board of Aldermen of the Town of Waynesville may adopt a resolution making other provisions for the possession and consumption of malt beverages and/or unfortified wine at special events of the town or at special community festivals. Any resolutions that may be adopted shall provide for the specific times, dates and geographical limitations of the special event or festival.

Section 134.06. Violations of Sections 134.01 and 134.03 shall be misdemeanors, punishable upon conviction by a fine not exceeding Five Hundred ($500) Dollars or by imprisonment not exceeding thirty (30) days, or both.

Chapter 133. Consuming Alcohol or Possessing Open Containers of Alcohol While on the Property of the Town of Waynesville on the Town of Waynesville Recreation Facilities

Section 133.01 It shall be unlawful for a person while on the property of the Town of Waynesville at any of the Waynesville Recreational facilities or parks to posses fortified or unfortified wine, spirituous liquor or any malt beverage in other than the manufacturer’s unopened original container.

Section 133.02 It shall be unlawful for a person while on the property of the Town of Waynesville at the Waynesville Recreation facilities and parks to consume fortified or unfortified wine, spirituous liquor or any malt beverage.

Section 133.03 The definitions of fortified or unfortified wine, spirituous liquor and malt beverage shall be the same as adopted by the North Carolina General Assembly in North Carolina General Statute 18B-101.

Section 133.04 Violations of Sections 133.01 and 133.02 shall be misdemeanors, punishable upon conviction of a fine not exceeding Five Hundred ($500) Dollars, or by imprisonment not exceeding thirty (30) days, or both.
