Chapter 130: General Offenses

Section 130.01 Failing to Pay Admission Charge

   It shall be unlawful to attempt to see any show or public entertainment for which a fee is charged without paying the required admission. (‘66 Code S 14-1.1) Penalty, see S 10.99

Section 130.02 Begging

 (A) No person shall beg or solicit alms in or on the streets or other public places of the town or in the entrances or corridors to or of any public building in the town without a permit issued to him therefor the Mayor.

 (B) No person shall sell or offer for sale any pencils, shoestrings, chewing gum, or similar objects in or on the streets or other public places of the town as an indirect method of soliciting alms; nor shall any person offer a cup or other receptacle for the deposit of money, or take up any collection in connection with the playing of any musical instrument in or on the streets or other public places of the town without having a permit therefor issued by the Mayor. (‘66 Code, S 14-4) Penalty, see S 10.99

Section 130.03 Expectorating

  It shall be unlawful for any person to expectorate tobacco juice or saliva from the mouth or put, place, throw, or deposit any amber juice, chewed tobacco, or cigar or cigarette stubs on any walls, floors, stairways, walks, or halls in any public building in the town. (‘66 Code, S 14-29) Penalty, see S 10.99.

Section 130.04 Acts Prohibited in a Public Place

 (A) It shall be unlawful for any person to knowingly or intentionally, in a public place:

  1. Engage in sexual intercourse;
  2. Appear in a state of nudity; or
  3. Fondle the genitals of himself/herself or another person.

 (B) It shall be unlawful for the owner or operator of any place of entertainment, including a restaurant, club, dance hall, or any other public establishment of any kind, to allow or permit any waiter or waitress, dancer, entertainer, or any other employee or visitor of such establishment to perform any of the acts listed in such establishment.

 (C) “Nudity” means the showing of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering; the showing of the female breast with less than a fully opaque covering of any part of the nipple and areola, or the showing of covered male genitals in a discernible turgid state.

 (D) Violations of this section shall be a misdemeanor punishable upon conviction by a fine not exceeding $50 or by imprisonment not exceeding 30 days. With respect to division (A) above, each separate incident shall constitute a separate offense. With respect to division (B) above, each day’s violation shall constitute a separate offense.
