Chapter 131: Offenses Against Public Peace and Safety

Section 131.01 Unlawful Assembly

   It shall be unlawful for any two or more persons within the town to assemble together for any unlawful purpose, or being assembled, to act in concert to do unlawful acts with force and violence against the property of the town or to the person or property of another, or against the peace of to the terror of citizens or other persons who shall make any movement or preparation therefor. No person shall knowingly suffer or permit any assemblage for the purpose of committing any unlawful act or breach of the peace or any riotous, offensive, or disorderly conduct in or upon the premises owned by him or under the control within the town.

Section 131.02 Inciting Breach of the Peace

   It shall be unlawful for any person to attempt to incite a breach of the peace or to incite a breach of the peace by engaging in boisterous cursing, swearing, profanity, or vulgar and offensive language on any street or public place. (‘66 Code, S 14-25) Penalty, see S 10.99.

Section 131.03 Discharge of Fireworks Prohibited

   No person shall set fire to or explode any fire crackers, fireworks, Roman candles, or other explosive material within the limits of the town. (‘66 Code, S 14-9) Penalty see S 10.99.

Section 131.04 Throwing Objects from Buildings

   No person shall throw from any window, porch, or door of any building or from the roof of a house any article which may endanger or annoy the pedenstrians on any street. (‘66 Code S 14-30) Penalty, see S 10.99

Section 131.05 Shooting or Projecting Hard Substances; Archery.

   No person shall shoot or propel any stone, rock, shot, or other hard substance by means of slingshot, bean shooter, shot shooter, pop gun, bow, or other similar contrivance; provided, archery shooting may be engaged in on such grounds as may be set aside and approved therefor by the Board of Aldermen. (‘66 Code 14-26) Penalty, see 10.99

Section 131.06 Discharging of Firearms

 (A) It shall be unlawful to shoot any gun or firearm in the town limits, except as provided in division (B).

 (B) The Chief of Police shall have authority to issue permits to individuals, entities, or groups for the shooting or discharging of guns or firearms within the town limits for properly supervised public or civic functions. Any such permit issued by the Chief of Police shall contain a limitation on the hours of the day during which the shooting may take place and shall contain a specific expiration date. Section 131.07 Discharging of Air Rifles, Pellet Guns Prohibited

   The firing or discharging of air rifles, BB guns, or pellet guns within the town is prohibited. (‘66 Code, S 14-2)  Penalty, see S 10.99)
