Chapter 71 Traffic Rules

Section 71.01 Vehicles Not to Obstruct Intersections

   No driver shall enter an intersection or a marked crosswalk unless there is a sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic-control signal indication to proceed. (‘66 Code, S 20-108) Penalty, see S 70.99.

Section 71.02 Driving Through Funeral Processions

   No vehicle shall be driven through a funeral procession except Fire Department vehicles, police patrols, and ambulances. (‘66 Code, S 20-14) Penalty, see S 70.99

Section 71.03 Clinging to Moving Vehicles

   Any person riding upon a bicycle, motorcycle, coaster, sled, roller skates or any toy vehicle shall not attach the same or himself to any public conveyance or moving vehicle upon any roadway. (‘66 Code, S 20-9) Penalty, see S 70.99.

Section 71.04 Use of Roller Skates, Coasters, and the Like

 (A) No person upon roller skates or riding in or by means of any coaster, toy vehicle or similar device shall go upon any roadway except while crossing a street at a crosswalk or intersection, except upon streets set aside as play streets. (‘66 Code, S 20-10)

 (B) No person shall ride any roller skates, skateboard, coaster, toy vehicle or similar device upon any sidewalk, street or mini-park in the areas of the Town of Waynesville described in division (C) of this section.

 (C) The areas in the Town of Waynesville in which division (B) of this section applies are described as “all streets, sidewalks and mini-parks within the Downtown Waynesville Tax District.” Streets and areas included are:

  1. Main Street from Assembly Street to Legion Drive;
  2. South Haywood Street from Main Street to Boyd Avenue;
  3. Legion Drive;
  4. Church Street from Montgomery Street to Wall Street;
  5. Wall Street from Pigeon Street to Main Street;
  6. This includes all businesses and parking lots adjacent to the streets listed;
  7. Also included are: The Greens Apartments, Hazelwood Presbyterian Church, Ingles (Barber Blvd.), K-Mart, Waynesville Plaza and Convenience King (corner of Pigeon and Main Streets). 

 (D) Except as provided, any person who violates division (B) of this section shall be guilty of a misdemeanor and shall, upon conviction, be punished by a fine of not in excess of $50 or imprisonment of not more than 30 days; provided further that any roller skate, skateboard, coaster, toy vehicle, or similar device used in the violation of this section shall be subject to forfeiture.

Section 71.05 Bicycle Riding

 (A) The operator of a motorcycle or bicycle when upon a street shall not carry any person upon the handlebar, frame, or tank of any such vehicle, nor shall any person so ride upon any such vehicle. (‘66 Code, S 20-8)

 (B) No person shall ride a bicycle or motorcycle on any street without having his hands upon the handlebars, nor shall any person ride a bicycle upon any sidewalk or walkway within the town. (‘66 Code, S 20-11)

Section 71.20 Speed Limits

   Except in those cases in which speed limits differing from those by provided by state law have been adopted by ordinance, and made effective by the adoption of a concurring ordinance by the State Board of Transportation, where required by state law, and by the erection within the town of signs giving notices of the authorized speed limits, the speed limits established by G.S. 20-141 shall apply within the town. A schedule of all authorized variation s from such limits, together with copies of ordinances of the Board of Aldermen, and of the State Board of Transportation where required by state law, authorizing such variations shall be maintained on file at the office of the Town Clerk.
